2. A Special Presentation by Attorney Terry Shumaker - "Employers Beware - New Rules and Hidden Risks for Non-Unionized Workplaces under the National Labor Relations Act”

Effective April 30, 2012, virtually every private sector employer in America will be required by the NLRB to post an 11x17-inch notice in “prominent places” in the workplace. The new notice contains detailed information about employee rights to unionize and file charges with the NLRB contesting discipline, work rules and other actions that employees perceive may interfere with their efforts to engage in what the NLRB finds to be “protected concerted” activity.

The presentation will also discuss:

  • Implementation and compliance with the Notice Rule, penalties for failure to post, the court challenge to the rule and possible employer responses to the NLRB posting.
  • Overview of another new NLRB rule slated to take effect April 30, 2012, which will severely restrict employer legal challenges and hasten union elections once a petition to unionize is filed by employees.
  • Review of recent NLRB decisions restricting disciplinary action of employees for Facebook and other social networking statements critical of their employers and invalidating workplace policies and rules that “chill” rights under the NLRA.
  • Q&A period on legal “do’s and don’ts” regarding union organizing.
